PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT
ALL PARTICIPANTS MUST READ AND AGREE
1. ACKNOWLEDGMENT AND CONSIDERATION
In consideration of being permitted to register for and/or participate in any event, activity, race, program, or related function (collectively, the “Event(s)”) organized, sanctioned, operated, or affiliated with Colorado Race Events, a DBA of BBSC Endurance Sports, LLC (“BBSC”), I, for myself and on behalf of my spouse, children, parents, guardians, heirs, next of kin, assigns, personal representatives, and any minor or other participant for whom I am registering (collectively, the “Participant”), hereby agree as follows.
2. ASSUMPTION OF RISK
I understand and acknowledge that participation in the Event(s) involves inherent and significant risks, including but not limited to: serious bodily injury, permanent disability, paralysis, death, property damage or loss; exposure to extreme weather or environmental conditions; water, road, and surface hazards; equipment failure; traffic and vehicle interaction; contact or collision with other participants, spectators, animals, vehicles, or objects; acts or omissions of other participants; inadequate safety measures; medical emergencies; and conditions beyond the control of the Event organizers.
I expressly and voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, including risks arising from the negligence of the Released Parties (as defined below), to the fullest extent permitted by Colorado law.
3. RELEASE AND WAIVER OF LIABILITY
I hereby release, waive, and forever discharge BBSC, Colorado Race Events, LLC, Flatirons Event Specialists, and all affiliated entities, sponsors, venue owners, municipalities, governmental entities, volunteers, medical personnel, contractors, employees, officers, directors, agents, and representatives (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether known or unknown, arising out of or related to my participation in the Event(s), including those caused in whole or in part by the negligence of the Released Parties, except to the extent prohibited by law.
4. INDEMNIFICATION AND HOLD HARMLESS
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees and court costs) arising from or related to my participation in the Event(s), or from any claim brought by or on behalf of me or any minor or third party for whom I am registering.
5. MEDICAL AUTHORIZATION AND CONSENT
I certify that I am physically fit, adequately trained, and capable of safely participating in the Event(s). I authorize BBSC and its medical personnel to provide emergency medical treatment as deemed necessary, and I accept full responsibility for the costs of such treatment.
I authorize BBSC to disclose limited medical and location information related to my participation, injury, treatment, or transport to my designated emergency contact, spouse, or next of kin. I understand that this authorization may be revoked in writing prior to the Event, subject to stated deadlines, and that it expires at the conclusion of the Event.
6. MEDIA RELEASE
I grant the Released Parties the irrevocable, perpetual, royalty-free right to photograph, record, and use my name, image, likeness, voice, quotes, and biographical information in any media now known or hereafter developed, for any lawful purpose including marketing, promotion, advertising, and event documentation, without compensation or prior approval. I waive any right to inspect or approve such use.
7. FEES AND REFUNDS
I acknowledge and agree that registration and administrative fees, including applicable processing or credit-card fees, are non-refundable, except as expressly stated in the Event’s published policies.
8. MINORS
If I am the parent or legal guardian of a minor participant, I consent to the minor’s participation and agree to all terms of this Agreement on the minor’s behalf. I further agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor.
9. SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10. GOVERNING LAW AND VENUE
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado. Any legal action arising out of or related to this Agreement or the Event(s) shall be brought exclusively in the state or federal courts located in Adams County, Colorado, and I expressly consent to such jurisdiction and venue.
11. ENTIRE AGREEMENT AND ACKNOWLEDGMENT
I acknowledge that I have read and fully understand this Agreement, that I am waiving substantial legal rights, and that I am signing it freely and voluntarily without inducement. This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or representations.
